Terms of Service
These Terms govern access to Crest Engines, a business software service provided by Crest Deployment Systems LLC, a New Jersey limited liability company operating as Crest Engines ("Crest," "we," or "us"). By creating an account, you agree to these Terms for yourself and the business you represent.
1. Business use and authority
Crest is offered for business use, not personal or household use. You must be at least 18 and authorized to act for each business you submit. You may provide only information, websites, accounts, and instructions that you have the right to provide. Creating an account does not authorize Crest to change a listing, publish content, contact another person, or enter a private system.
2. What the service does
Crest measures how public AI and search systems describe a business, preserves supporting evidence, and proposes actions for human review. AI and search systems change and can be incomplete or wrong. Crest does not promise a ranking, mention, revenue result, or specific third-party response. Counts reflect the stated method, models, questions, and sample at the time measured.
3. Accounts and plans
Keep account access secure and provide accurate account information. Free and paid plans have the limits shown in the product when an operation is requested. A paid plan renews until cancelled. Fees are nonrefundable except where required by law or expressly stated at purchase. Crest may refuse an operation that would exceed its plan allowance, agent balance, safety rule, or external provider limit.
4. Your data and instructions
You retain ownership of information you submit and of your customer-specific Crest record. You grant Crest a limited right to host, process, and transmit that information only to provide, secure, support, and improve the service as described in the Privacy Policy. You may export your record without a plan charge. You are responsible for reviewing a recommendation before using it.
5. Acceptable use
You may not use Crest to:
- access a system, account, or data without authorization;
- bypass authentication, paywalls, CAPTCHAs, rate limits, or technical controls;
- submit false business facts or impersonate a person or business;
- make consequential decisions about a natural person in employment, credit, housing, healthcare, insurance, education, or a similar regulated area;
- send unlawful messages, violate privacy or intellectual-property rights, or introduce harmful code;
- resell, scrape, or systematically extract the service or another customer's data.
6. Third-party services
Crest relies on hosting, authentication, AI, search, email, and other processors. Their availability and outputs are outside Crest's complete control. Enabling a future integration will authorize only the scopes displayed for that integration. Provider terms may also apply to accounts you connect.
7. Intellectual property and feedback
Crest and its software, methods, branding, and non-customer service content belong to Crest and its licensors. These Terms grant a limited, revocable right to use the service during your account term. You may provide feedback, and Crest may use it without identifying you or owing compensation.
8. Suspension and termination
You may stop using Crest and request deletion from Account settings. Crest may suspend access to protect the service, comply with law, prevent unauthorized use, or address a material breach. We will give notice when reasonably possible. Terms that by their nature should continue after termination remain effective.
9. Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available." Crest disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation. Crest provides business analysis, not legal, tax, medical, financial, or other licensed professional advice.
10. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profit, revenue, goodwill, or data. Crest's total liability arising from the service will not exceed the greater of $100 or the amount you paid Crest for the service during the 12 months before the event giving rise to the claim. This section does not limit liability that cannot lawfully be limited.
11. Governing law and changes
New Jersey law governs these Terms without regard to conflict-of-law rules. State and federal courts located in New Jersey have exclusive jurisdiction, unless the parties agree otherwise in a signed order. We may update these Terms prospectively. We will present a new acceptance when a material change requires it.
